Access right

WHAT IT IS?

It is the right to access public information, in the terms provided in article 105.b) of the Spanish Constitution. Public information is understood as the contents or documents, whatever their format or support, which are held by the subjects subject to Law 8/2015 of March 25, on Transparency of Public Activity and Civic Participation of Aragon, and that have been prepared or acquired in the exercise of their functions.

All persons have the right to access public information without giving reasons for application/

Access to the information will be free in general, and it will be made available in the requested form or format, whenever possible.

Requests for the right of access to public information will follow the procedure established in Law 19/2013 of December 19, on transparency, access to public information and good governance, as well as Law 8/2015 of March 25, of Transparency of Public Activity and Citizen Participation of Aragon.

The Order of October 26, 2015, of the Counsellor of Citizenship and Social Rights, which establishes instructions on the processing, monitoring, control and registration of requests for access to public information, also applies.

The Aragonese Law, in terms of right of access, includes the following specialities:

  •  The applicant will receive a prior notification, within a maximum period of ten days from receipt of the request by the competent body to resolve, in which the date of receipt of the request will be indicated, term for its resolution and effects of administrative silence.
  • In general, after the maximum period to resolve without the applicant having received a response, it will be understood that your request has been considered.
  • The resolution of the prior optional claims regarding the right of access to public information corresponds to the Aragon Council of Transparency.

The bodies and units competent in matters of right of access to public information are those included in the Appendix of Decree 215/2014, of December 16 of the Government of Aragon, of attribution of competencies in matters of exercise by citizens of the right of access to public information in the field of the Administration of the Region of Aragon and its public sector.
